IJU Hails Bombay HC Verdict Striking Down FCU

KalimNews, New Delhi, 25 September 2024: The Indian Journalists Union (IJU) welcomes Bombay High Court order striking down as “unconstitutional” the amended IT Rules, 2021 rules which empower the Centre to identify “fake news” on social media platforms through a Fact Check Unit (FCU).

On Friday last, a third judge, Justice Atul S Chandurkar, gave the deciding opinion after a two-judge bench had given a split verdict on the petitions, challenging validity of the rules as being ultra vires or exceeding provisions of IT Act, 2000. He agreed with petitioners the rules were violative of Article 14 (equality before law) and 19 (1) (a) and 19 (1) (g) of Constitution (right to freedom of speech and expression, and right to practice a profession or trade).

As per IT rules amended in April 2023, content marked by FCU as “fake or misleading” will have to be taken down by online intermediaries if they wish to retain their “safe harbour” (legal immunity against 3rd-party content). 

The petitioners, stand-up comedian Kunal Kumra, Editors Guild of India, News Broadcasters and Digital Association, Association of Indian Magazines, had challenged these saying the rules made central government the sole arbiter of truth in respect of its business, obliging private parties to impose that version of truth on all users. “This provision, therefore, makes the government the sole gatekeeper of the marketplace of ideas and constitutes a clear breach of Article 19(1)(a) (freedom of speech and expression).” 

While stating that expressions “fake, false or misleading” are “vague and overbroad”, and “test of proportionality” is not satisfied, Justice Chandurkar noted it was also “not a responsibility of the state to ensure that citizens are entitled only to ‘information’ that was not fake, false or misleading as identified

by FCU”. There was “no basis or rationale” to determine whether information viz Central Government business is either fake or false when in digital form, while not taking similar exercise when the same information is in print. The impugned rule resulted in a “chilling effect” for the intermediary.

In a statement, IJU President and former member of Press Council of India Geetartha Pathak and Secretary General and International Federation of Journalists (IFJ) Vice President Sabina Inderjit said the verdict has not only safeguarded the right to freedom of speech and expression but has protected the citizens’ right to information. The Centre’s FCU would have led to veiled censorship as well as had a chilling effect on freedom of speech, essential to democracy.

BJP General Secretary of Hooghly, Suresh Saw, mocked her for conflating the measurement of water with “quintals,” suggesting, “The Chief Minister should place the MP in a museum for making such statements.” Saw’s jab was part of a broader critique of the Trinamool Congress’s handling of the situation.

In her defense, Banerjee said the central government has not provided adequate support for crucial flood control projects, including the Ghatal Master Plan. She praised Chief Minister Mamata Banerjee for her initiative in addressing the issue, adding that efforts are underway to explore solutions for erosion control in Balagarh.

Banerjee remained critical of the DVC but refrained from commenting further on the Chief Minister’s stance, saying, “I won’t say more about what our respected leader has already stated.”

District Magistrate Khurshed Ali Qadri and Superintendent of Police Dhritiman Sarkar visited the Mothers Hub and Maternity Department at Ghatal Hospital on Tuesday to oversee operations and provide support.


Despite the challenging flood conditions, 112 expectant mothers from various flood-prone areas were safely transported to the hospital. Many faced perilous journeys; some were brought in using tractors, while others utilized Civil Defense and SDRF boats to navigate the flooded terrain.

During their visit, the officials distributed sarees to the admitted women and provided fruits and essentials to five new mothers, demonstrating the administration’s commitment to the well-being of both mothers and newborns.


Thanks to the collaborative efforts of ASHA workers, healthcare professionals, and local administration, there were no reported fatalities during this critical time, and the births proceeded smoothly. Of the 112 women admitted, 56 mothers have already given birth and have returned home as the waters recede. Currently, 24 mothers with newborns remain hospitalized, primarily because their homes are still inundated.

Moreover, reports indicate that over 30 additional mothers are in good health and recovering well. This concerted effort highlights the resilience and determination of the community and local authorities to prioritize maternal health and safety, even in the face of natural disasters.

The successful management of maternity services amid such adversity stands as a testament to the strength of the local healthcare system and the unwavering support of the community. As the floodwaters begin to recede, the focus remains on ensuring the safety and health of all mothers and their newborns in Ghatal.

In a series of tweets, he raised questions about the RG Kar case, specifically asking, “Who identified the victim as the uncle of the deceased young woman? Who insisted on a swift autopsy? From whom did the threats originate?”


Adhikari also named the individual implicated in these allegations, suggesting that this person may be affiliated with the ruling Trinamool Congress party. This follows a lengthy interrogation of the individual on Sunday, during which he reportedly made alarming statements to reporters as he left.

CBI Pursues New Leads in RG Kar Medical College Case, Summons Multiple Doctors

The situation at RG Kar has become increasingly tense as authorities delve deeper into the circumstances surrounding the case.


The CBI officials were seen entering the hospital’s ‘Platinum Jubilee’ building, where they are expected to gather crucial information related to the investigation. Sources indicate that two forensic medicine experts from RG Kar Hospital were also summoned to the CBI office on the same day, highlighting the investigative body’s effort to piece together the details surrounding the case.

One of the central figures in this investigation is Dr. Apurba Biswas, one of the three doctors responsible for conducting the post-mortem of the victim. The CBI has summoned Dr. Biswas once again to the CGO complex for questioning, underscoring the importance of his testimony in the ongoing inquiry. He arrived at the CBI office at noon, where investigators are meticulously recording his statement.

In a related development, Chinmoy Biswas, a sub-inspector from the Tala police station, also appeared at the CGO complex following a summons from the CBI. This comes in the wake of the arrest of the station’s officer-in-charge, Abhijit Mondal, by the CBI, raising questions about the handling of the case by local law enforcement. Sub-inspector Biswas was reportedly present at the crime scene shortly after the incident was reported on the morning of August 9, working alongside the investigating officer from the police station.

Additionally, three doctors close to the victim, identified as Sandeep Ghosh, have also been called back to the CBI office for further questioning. The event, which took place in various locations, included beneficiaries from Khanpur Vidyalaya in Hooghly district, Narayanpur in Hooghly district, and Harangiri in North 24 Parganas. Of the students receiving assistance, 87 were girls and 75 were boys, ensuring that the joy of the festive season reached those in need.

Anandam, founded in 2017 by alumni of the Kolkata Advaita Ashram’s Vivekananda Study Circle, has consistently dedicated itself to community service, aiming to uplift the less fortunate in West Bengal. Since its inception, the organization has made significant strides in various charitable initiatives, including clothing distributions, medical support, and essential food supplies during the COVID-19 pandemic.
