Supreme Court to Hear West Bengal’s Plea Against Calcutta High Court Stay on Revised OBC List on July 28


Baby Chakraborty, KalimNews, Kolkata, July 24, 2025 : The West Bengal government has moved the Supreme Court challenging the Calcutta High Court’s June 17 order which stayed the State’s revised list of Other Backward Classes (OBCs). The State’s appeal was mentioned on Thursday before Chief Justice of India BR Gavai by Senior Advocate Kapil Sibal, who sought an urgent hearing of the matter. Responding to the request, the CJI agreed to list the matter for hearing on Monday, July 28.

The legal row stems from the Calcutta High Court’s earlier decision in May 2024, which quashed the inclusion of 77 communities in the OBC list. The division bench of Justices Tapabrata Chakraborty and Rajasekhar Mantha had invalidated all OBC certificates issued by the State since 2010, effectively nullifying nearly 12 lakh such certificates. Following this, the West Bengal government had approached the Supreme Court, which is still considering the matter. In response to the High Court ruling, the State informed the Court that the West Bengal OBC Commission would carry out a fresh assessment to identify eligible OBC communities.

Subsequently, the State government issued a new list based on this commitment. However, this revised list was also stayed by the Calcutta High Court on June 17. In its interim observation, the High Court suggested that the State appeared to be attempting to reintroduce the same communities previously disqualified, prompting further judicial scrutiny.

Challenging this fresh stay, Kapil Sibal submitted before the Supreme Court that the High Court’s position contradicts established legal precedent. He argued that a writ petition had been filed against the new list, wrongly insisting that a legislative route was necessary for such classification. Sibal pointed out that this approach was contrary to judicial interpretations, particularly the landmark 1992 Indira Sawhney judgment (commonly referred to as the Mandal Commission case), which affirmed that the executive branch has the authority to identify OBCs.

Chief Justice Gavai concurred with this principle, reiterating that the judiciary has consistently held that the executive can undertake such identification. In addition, Sibal highlighted that a contempt petition had been filed in the Calcutta High Court over the issue. He urged the Supreme Court to stay the contempt proceedings, stating that no act of contempt had occurred. The Chief Justice took note of this and said the Court would address the issue after listing the case for Monday.

The State government’s challenge against the June 17 order is part of a broader legal and administrative struggle over the classification and recognition of backward communities. While the High Court has maintained that the State must avoid reintroducing previously disqualified communities without fresh assessment, the government has asserted that it is within its executive powers to revise the OBC list, especially following new data and recommendations from the State Commission.

With the matter now slated for hearing on July 28, the Supreme Court’s upcoming order is expected to have significant implications for affirmative action policy and the legal framework governing backward class identification in West Bengal.

However, the veteran leader has expressed deep dissatisfaction with the Murshidabad district leadership of the Trinamool Congress (TMC), claiming that they are blatantly ignoring the party’s central directives.

In an exclusive interview with TV9 Bangla, Humayun Kabir disclosed that he plans to form a new political party in opposition to the district leadership’s actions. Despite his long association with the TMC, Kabir is taking a significant step in the lead-up to the 2026 West Bengal Legislative Assembly elections, planning to contest on 50 seats across the districts of Malda, Murshidabad, South Dinajpur, and Nadia. The new party will aim to represent the minority communities in the region, particularly those who feel sidelined by the existing leadership.

“I have no grudge against Mamata Banerjee and Abhishek Banerjee,” Kabir emphasized, but added, “The district leadership in Murshidabad is not even following the orders of the leader. They are ignoring the party’s instructions, which is deeply troubling.” His discontent stems from the growing importance given to junior party members such as Apurba Sarkar and Khalilur Rahman, who he believes have been promoted over more senior and deserving leaders.

Humayun Kabir’s remarks reveal a sense of disillusionment with the current state of leadership. He said, “I want to form a party to prove that farming is done with oxen, not goats. He questioned why the district leadership is failing to represent the true sentiments of the people. “There are many people who support ox-driven farming, but the district leadership seems more inclined to support the goats. Bail Extended for Sujoy Krishna Bhadra in Recruitment Corruption Case, No Relief for Confinement Requests

Justice Shuvra Ghosh issued the ruling, extending Bhadra’s bail until August 31, 2025. However, Bhadra’s requests for greater flexibility in his confinement conditions were rejected by the court.

Sujoy Krishna Bhadra, who has been arrested by both the Enforcement Directorate (ED) and the Central Bureau of Investigation (CBI) in connection with the recruitment scam, had previously spent time in jail and was subsequently admitted to the hospital due to health issues. Considering his medical condition, the Calcutta High Court had granted him interim bail under several conditions, including a strict restriction on his movement outside his residence in Behala. During the past few months, he has been confined to his home unless seeking medical treatment.

This time, Bhadra’s defense lawyer Milan Mukherjee argued for the easing of the confinement restrictions, asking the court to allow Bhadra to stay within the jurisdiction of the trial court instead of being restricted to his residence. Mukherjee also pointed out that despite the passage of five months since Bhadra was granted interim bail, the CBI had not questioned him even once in connection with the case.

However, CBI counsel Dhiraj Trivedi opposed the plea, emphasizing that the interim bail had been granted on the grounds of Bhadra’s health condition. He stated that allowing him to leave his Behala residence, even under limited conditions, would not be appropriate given the circumstances.

National Security Guard Leads Major Counter-Hijack and Counter-Terrorism Drill at Kolkata’s NSCBI Airport

Security Forces Collaborate in Mock Exercises to Enhance Emergency Preparedness


Baby Chakraborty, KalimNews, July 21, 2025, Kolkata :  In a well-coordinated security exercise aimed at bolstering the response capabilities of various agencies in critical situations, the Netaji Subhas Chandra Bose International Airport (NSCBI), Kolkata, hosted a joint counter-hijack and counter-terrorism drill during the night of July 18 and the early hours of July 19, 2025.

The exercise, led by the National Security Guard (NSG), was conducted in light of past security concerns that had surfaced earlier this year when tensions between India and Pakistan had led to heightened security at airports across the country. While Kolkata’s NSCBI Airport was not directly affected by the NOTAM (Notice to Airmen) restrictions issued to other airports during the conflict, tight security measures had remained in place, with paramilitary forces and state police constantly monitoring the area.

On the night of the 18th, a series of mock counter-terrorism and hijacking exercises were launched to assess the preparedness of both airport security personnel and response agencies in the event of an emergency.

The first phase of the drill began at 9:34 p.m., when Air Traffic Control (ATC) received an emergency call regarding a hijacking situation involving an A320 aircraft. The aircraft, carrying 75 ‘dummy’ passengers and crew, was diverted to the Isolation Bay of the airport as part of the simulation. The Central Industrial Security Force (CISF) quickly cordoned off the surrounding area while the Intelligence Bureau (IB) and the Ministry of Home Affairs (MHA) initiated negotiations with the hijackers in an attempt to resolve the crisis peacefully.

When talks failed to yield results, the NSG’s Counter Hijack Task Force (CHTF) took action, launching a tactical operation to storm the aircraft. The operation, which saw the simulated rescue of all passengers and the neutralization of the “hijackers,” successfully concluded at 2:15 a.m. on July 19.

Running in parallel with the hijack simulation, a separate counter-terrorism drill was initiated at around 9:00 p.m. that same evening. The scenario involved an armed assault on Airports Authority of India (AAI) operational offices, where twelve AAI staff members were “taken hostage,” and the power supply was disabled.

The Special Task Force (STF) of West Bengal Police quickly took control of the perimeter but faced intense resistance during their entry attempt, simulating casualties among officers. After the hijack operation concluded, the NSG Task Force was deployed to handle the hostage situation. Following a detailed briefing from the STF, the NSG team executed a tactical operation that led to the successful rescue of all hostages and the neutralization of six “terrorists.” This operation was completed at 4:25 a.m. on July 19.

The exercise, which was meticulously planned and executed, involved a multi-agency collaboration, including personnel from the Airports Authority of India (AAI), CISF, ATC, state police, IB, MHA, and NSG. The drills were designed to test not only the physical preparedness of these agencies but also their ability to coordinate in a fast-paced, high-stakes environment. Officials emphasized the importance of refining crisis management protocols and improving communication flow across multiple agencies.

In a statement, officials from the NSCBI Airport thanked all participating agencies for their dedication to maintaining the highest standards of aviation security and ensuring public safety. They emphasized that the successful conclusion of the exercise underscored the importance of constant vigilance and readiness in the face of evolving security threats.

Citing the site’s symbolic value as part of the Bangla cultural renaissance, the ministry urged Bangladesh to reconsider its decision and explore possibilities for restoring the structure. India also extended a formal offer to assist in its renovation, proposing that the building could be transformed into a museum of literature—a testament to the enduring cultural legacy shared by both nations.

“A building of such landmark significance should not be erased,” the MEA noted. “It is preferable to examine options for its repair and reconstruction as a space that commemorates literary and cultural contributions. India would be willing to extend full cooperation toward this effort.”

Following growing domestic and international pressure, the demolition was suspended on Wednesday by orders from the local administration in Mymensingh. However, a day later, the Bangladesh Ministry of Foreign Affairs released a statement firmly denying any historical link between the property and the Ray family. It asserted that archival research had found no credible evidence connecting the house to Upendrakishore Ray Chowdhury or any member of the Ray lineage.

According to the ministry’s statement, land and historical records indicated that the structure was originally built by Shashikant Acharya Chowdhury, a local zamindar, as staff quarters near his estate, Shashi Lodge. The building later became government property following the abolition of the zamindari system and was leased to the Bangladesh Shishu Academy. It was never declared an archaeological heritage site and has been officially classified as khas (state-owned) land.

The ministry also stated that consultations with local historians and senior citizens had yielded no evidence linking the structure to the Ray family. The only documented association to the Ray legacy in the area, it claimed, was the naming of Harikishore Ray Road—named after Ray’s great-grandfather. While the Ray family did own a residence on that road at one time, the house in question was reportedly sold long ago and replaced by a modern structure.

The ministry further explained that the decision to dismantle the old building was made earlier this year, with the goal of replacing it with a new semi-permanent facility for children’s development. A public tender for demolition had been issued through national and regional newspapers on March 7, 2025.

Nonetheless, heritage activists and some local historians remain unconvinced. In interviews published by leading Bangladeshi media outlets such as The Daily Star and Prothom Alo, critics claimed that the historical and cultural value of the building had long been neglected. Poet and activist Shamim Ashraf lamented that the structure had fallen into disrepair due to years of official apathy. “Cracks had developed on the roof, and the building was clearly deteriorating. Yet, despite its heritage significance, authorities chose demolition over restoration,” he said.

The backlash has prompted fresh discussions on the treatment of shared heritage sites in the subcontinent, particularly those linked to prominent figures like Satyajit Ray.
